Position Specific Description
Assist with the coordination of all of NEER’s CFTC and FERC (or other regulatory agencies as required) compliance activities, both internally and externally with regulating agencies. The mission of the role is to assist the Business Units in ensuring compliance with all CFTC and FERC requirements by working directly with NEER Business Units to implement and maintain a sustainable culture of compliance. Assist the NEER business units in reviewing, revising and implementing adequate compliance processes and controls to ensure the Business Units are properly complying with mandated regulations and other rules affecting physical and financial commodity transactions. Participate in educating and/or training personnel on compliance procedures and new regulations.
Liaise with the NEE Corporate Responsibility Office (CRO), Federal Regulatory Affairs (FRA), Trading Risk Management, Commercial groups, and Information Management with respect to applicable regulatory and compliance responsibilities owned by each of the groups. Participate in general oversight of regulatory compliance performance of traders and personnel charged with regulatory implementation. Assist with compliance risk assessments and testing and monitoring of programs in accordance with regulatory expectations and best practices. Assist Business Units within the Company in the preparation and submittal of documents required for NEER’s CFTC and FERC compliance activities.
Responsibilities include, but are not limited to:
• Monitoring trading activity, business unit processes and procedures, and required reporting obligations to ensure compliance with CFTC regulations by analyzing data, building/modifying reports, and/or running queries.
• Review trade and communications data for activity that may appear manipulative in nature and be able to assess when to escalate suspicious behavior
• Prepare annual compliance reports required by internal management or any of the business units’ regulatory agenciesDevelop new processes for reviewing trade and communications data as relates to CFTC and FERC market manipulation cases
• Help with applicable CFTC risk assessments, rule impact analysis, testing controls, etc.
• Assist in gathering and analyzing compliance metrics and reporting to senior management
• Work closely with IT to provide guidance on required enhancements to system functionality, assist in testing compliance functionality, prioritization of tasks, and ensure projects are delivered on time to adhere to compliance deadlines.
