California Job Applicant Privacy Notice at Collection


This Privacy Notice (“Notice”) applies to our job applicants (and their emergency contact, dependents and spouse) (collectively “job applicants”) who reside in California and are applying for employment at a NextEra Energy Inc. company doing business in California. We will refer to these California companies as “we,” “us” or “our” throughout this Notice.  

This Notice will describe the categories of personal information we collect, examples of the personal information for each category, and for what purpose we use that personal information.  

This Notice is effective January 1, 2020. Any material updates to this Notice or our privacy practices will be provided to you. 

For purposes of this Notice: “Personal information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked with a natural person, that we collect about our job applicants who reside in California, in their capacity as job applicants.  

If you have provided personal information to us about your emergency contact, dependents and/or spouse, please share this Notice with them.

This Notice is not a job offer or promise of employment with us.  This Notice is solely to provide job applicants with a full disclosure of personal information that may be collected and used by us as part of the job application process, and in accordance with California privacy laws.

Personal Information We Collect and How We Use It  

Personal information you may be requested to provide us, or that we may collect about you, and how we use that information, is listed below; however, not all categories, examples and uses apply to every job applicant.

1. Category: Identifiers
     a. Examples include: Name, address, contact information, and government issued identification, like Social Security number
     b. How we use it:
          i. To manage personnel and pre-employment matters and record with us regarding your application, including: identifying you, communicating with you, evaluating your application, background checks, emergency contacts, staffing, and other job applicant related activities
          ii. To comply with legal or regulatory requirements for job applicants, including government reporting, investigations, legal proceedings, record-keeping, and for audit purposes
         iii. To ensure and enhance the security of our electronic systems, corporate network, and managed devices
         iv. To protect against fraud; to create and administer Information Technology (“IT”) (including email, phones and internet use) access rights, and for cyber security purposes
          v. To manage health, safety and security in our workplace, and to report on incidents in accordance with relevant and applicable laws

2. Category: Personal information categories under California law §1798.80(e)
     a. Examples include: Similar identifiers as above, and other identifiers like badge photos, insurance, health and education information, employment history, and financial information regarding your application with us.
     b. How we use it: 
          i. To manage personnel and pre-employment matters and record with us regarding your application, including: identifying you, communicating with you, evaluating your application, background checks, emergency contacts, staffing, and other job applicant related activities
          ii. To comply with legal or regulatory requirements for job applicants, including government reporting, investigations, legal proceedings, record-keeping, and for audit purposes
          iii. To comply with other legal obligations, such as to accommodate disabilities; and other record-keeping
          iv. To conduct fitness-for-duty examinations, as applicable
           v. To ensure and enhance the security of our electronic systems, corporate network, and managed devices 
          vi. To protect against fraud; to create and administer IT access rights, and for cyber security purposes
          vii. To manage health, safety and security in our workplace, and to report on incidents in accordance with relevant and applicable laws
3. Category: Protected classification characteristics under California or federal law
     a. Examples include: Age, race, national origin, marital status, medical information, sex, gender, and military status
     b. How we use it: 
          i. To manage any applicable benefits being offered to you (and your family)
          ii. To comply with legal or regulatory requirements for job applicants, such as compliance with the Equal Employment Opportunity Act, the federal Office of Contracting Compliance Programs; the Family Medical Leave Act, immigration laws; other applicable California employment laws; and to comply with other legal obligations, such as to accommodate disabilities
          iii. To comply with legal or regulatory requirements for job applicants, including government reporting, investigations, legal proceedings, record-keeping, and for audit purposes
4. Category: Biometric information
     a. Examples include: physiological, biological or behavioral characteristics
     b. How we use it:
          i. To ensure and ensure the security of our information and electronic systems, corporate network, and managed devices

5. Category: Internet or other similar network activity
     a. Examples include: Activities regarding the use of our job applicant related systems or other systems used by job applicants during the application process

          ii. To protect against fraud, to create and administer IT access rights, and for cyber security purposes
         iii. To manage health, safety and security in our workplace, and to report on incidents in accordance with relevant and applicable laws

6. Category: Geolocation data
     a. Examples include: Physical location or movements
     b. How we use it:
          i. To ensure and enhance the security of our information and electronic systems, corporate network, and managed devices

         iii. To manage health, safety and security in our workplace, and to report on incidents in accordance with relevant and applicable laws

7. Category: Audio, electronic, and visual information
     a. Examples include: Activities and usage of our electronic devices and systems, and video cameras
     b. How we use it: 
          i. To ensure and enhance the security of our information and electronic systems, corporate network, and managed devices
          ii. To protect against fraud; to create and administer IT access rights, and for cyber security purposes
         iii. To manage health, safety and security in our workplace, and to report on incidents in accordance with relevant and applicable laws

8. Category: Professional or employment-related information
     a. Examples include: Current or past job history, employment application, membership in professional organizations, professional certifications, skills, work preferences and eligibility in order to comply with legal requirements
     b. How we use it: 
          i. To manage personnel and pre-employment matters and record with us regarding your application, including: identifying you, communicating with you, evaluating your application, background checks, emergency contacts, staffing, and other job applicant related activities
          ii. To comply with legal or regulatory requirements for job applicants, including government reporting, investigations, legal proceedings, record-keeping, and for audit purposes
         iii. To ensure and enhance the security of our electronic systems, corporate network, and managed devices

9. Category: Non-public education information
     a. Examples include: education records
     b. How we use it: 
          i. To manage personnel and pre-employment matters and record with us regarding your application, including: identifying you, communicating with you, evaluating your application, background checks, emergency contacts, staffing, and other job applicant related activities
          ii. To assist us with staffing, performance, compensation, retention, and determining suitability for job roles and training
         iii. To comply with legal or regulatory requirements for job applicants, including government reporting, investigations, legal proceedings, record-keeping, and for audit purposes
10. Category: Inferences drawn from any of the above information and used to create a profile. 
     a. Examples include: Talent profiles information such as career interests and mobility and relocation preferences
     b. How we use it:
          i. To determine suitability for employment, to develop a talent pool and plan for succession, to determine eligibility for training courses, and to assist with professional licensing
11. Category: Background screening and investigation information
     a. Examples include: Criminal history, motor vehicle records, credit, employment, drug testing and educational histories
     b. How we use it:
          i. To screen for risk; suitability for jobs, and to manage pre-employment relationship and record with us during the application process
          ii. To comply with legal or regulatory requirements for job applicants, including government reporting, investigations, legal proceedings, record-keeping, and for audit purposes
         iii. To ensure and enhance the security of our electronic systems, corporate network, and managed devices
          iv. To protect against fraud; to create and administer IT access rights, and for cyber security purposes
          v. To manage health, safety and security in our workplace, and to report on incidents in accordance with relevant and applicable laws
Purposes Potentially Applicable to Any of the Categories of Personal Information Listed Above

We may also use personal information to facilitate administrative functions and information technology operations and for legal reasons and corporate transactions. These functions include, but are not limited to the following:

  • to manage and operate information technology and communications systems, risk management and insurance functions, budgeting, financial management and reporting, strategic planning;
  • to manage litigation, and other legal matters and inquiries and to meet legal and regulatory requirements; 
  • in connection with a corporate transaction, sale, or assignment of assets, merger, divestiture, or other changes of control or our financial status or any of related subsidiaries or affiliates; and 
  • to manage licenses, permits and authorizations applicable to our business operations.
